It is the policy of this school that elected or appointed school governance body members, school administrative officers, and school employees shall not place themselves in any position where their private, personal interests may conflict with their official duties, or where they may directly or indirectly receive personal financial gain through direct or indirect personal influence.
All such persons shall be neither personally nor financially interested in any contract made by them or by the school that employs them. For purposes of this policy,
1) 'personally interested' shall mean any situation where private, personal interests conflict with official duties and shall include non-economic interests such as familial relationships, and
2) 'financially interested in any contract' shall mean any contract with an individual, entity, or company in which any such person, any such person's spouse, parents, children, civil partner, or any other person with a close personal relationship to any such person has an ownership interest, an investment interest, or a familial interest, and encompasses any situation where any such person's official judgment may be influenced by personal consideration or expectation of financial gain or any compensation or consideration of any kind other than that officially provided to any such person by the school.
All potential Conflict of Interest matters will be evaluated on a case by case basis.

Sky Mountain Charter School believes that free inquiry and exchange of ideas are essential parts of a democratic education. The School respects students' rights to express ideas and opinions, take stands on issues, and support causes, even when such speech is controversial or unpopular.
Students' freedom of expression shall be limited only as allowed by Education Code 48907, 48950, and other applicable state and federal laws.
Students are prohibited from making any expressions or distributing or posting any materials that are obscene, libelous, or slanderous. Students also are prohibited from making any expressions that so incites students as to create a clear and present danger of the commission of unlawful acts on school premises, the violation of school rules, or substantial disruption of the school's orderly operation. (Education Code 48907)
The use of "fighting words" or epithets is prohibited in those instances where the speech is abusive and insulting, rather than a communication of ideas, and the speech is used in an abusive manner in a situation that presents an actual danger that it will cause a breach of the peace.
School officials shall not engage in prior restraint of material prepared for official school publications except insofar as the content of the material violates the law. (Education Code 48907)
The School shall not discipline any high school student solely on the basis of speech or other communication that would be constitutionally protected when engaged in outside of school, but may impose discipline for harassment, threats, or intimidation unless constitutionally protected. (Education Code 48950)
A student shall be subject to discipline for off-campus expression, including expression on off-campus Internet web sites, when such expression poses a threat to the safety of other students, staff, or school property, or substantially disrupts the educational program. The School Director or designee shall document the impact the expression had or could be expected to have on the school program.
A. This policy shall apply to all pupils enrolled in Sky Mountain Charter School (SMCS), an independent study charter school serving pupils in grades K-12.
B. Students who attend SMCS will be educated through individually designed curricula, which may include, but are not limited to, non-classroom based learning programs, cooperative school programs and classes, apprenticeships, on-the-job training, community-based educational programs, group seminars, distance learning via current technology, and supplemental learning projects.
C. The Charter School shall comply with all state and federal Charter School laws regarding independent study instruction.
D. Each student's independent study shall be coordinated, evaluated, and carried out under the general supervision of an assigned certificated employee or employees of the Charter School.
E. The maximum length of time that may elapse between the time an independent study assignment is made and the date by which the student must complete the assigned work shall be no more than twenty (20) school days, or as modified by an assigned credentialed teacher at the time the work is assigned to the pupil.
F. Students who fail to demonstrate adequate and appropriate monthly progress toward the student standards, as determined by the professional judgment of the credentialed teacher assigned to that student, will be subject to expulsion in accordance with the terms of this Charter.
After one (1) missed school appointed meeting, an evaluation shall be conducted to determine whether it is in the best interests of the pupil to remain in independent study. A written record of the findings of any review made pursuant to this subdivision shall be maintained in the pupil's permanent record. The review may consist of some or all of the following:
Monthly review of work
Parent, student, and Education Specialist observation
Norm and criterion referenced tests
Student work samples
Daily Attendance Logs
The role of the credentialed teacher is critical to the success of charter school independent study students. The teacher's observations, discussions with parents and students, and examinations of written work are the key to quality control.
G. A current written student agreement for each independent study pupil shall be maintained on file for each participating student. Each written student agreement shall be signed and in effect prior to the start of reporting attendance (ADA) pursuant to that agreement. Students must meet all elements of the written student agreement in order for continued enrollment in this charter school. The independent study agreement for the student must require and cover a study plan that represents the same amount of study that would be required of a student in a classroom, and must require that the student has the ability to complete the study plan assignments in an independent study setting.Written agreements will include subsidiary agreements, such as course contracts and assignments, work records, and testing requirements. Each agreement shall also include the following:
The manner, time, frequency, and place for submitting a pupil's assignments and for reporting his or her progress.
The objectives and methods of study for the pupil's work, and the methods utilized to evaluate that work.
The specific resources, including materials and personnel that will be made available to the pupil.
A statement of the policies adopted regarding the maximum length of time allowed between the assignment and the completion of a pupil's assigned work, and the number of missed assignments allowed prior to an evaluation of whether or not the pupil should be allowed to continue in independent study.
The duration of the written student agreement, recognizing that no written student agreement shall be valid for any period longer than one school year.
A statement of the number of course credits or, for the elementary grades, other measures of academic accomplishment appropriate to the agreement, to be earned by the pupil upon completion.
The inclusion of a statement in each written student agreement that attendance at this charter school is an optional educational alternative in which no pupil may be required to participate.
Each written student agreement shall be signed, prior to the commencement of independent study, by the pupil, the pupil's parent, legal guardian, or caregiver, if the pupil is less than 18 years of age, the certificated employee who has been designated as having responsibility for the general supervision of independent study, and all persons who have direct responsibility for providing assistance to the pupil.
If a parent or student knowingly provides any false information on the student application, the student shall be immediately dismissed from the Charter School.
H. The Charter School shall not provide any funds or other things of value to the pupil or his or her Parent or guardian that a school district could not legally provide to a similarly situated pupil of the school district, or to his or her parents or guardian.
I. The Charter School may only receive funding for the provision of independent study to pupils who are residents of San Bernardino County or who are residents of a county contiguous to San Bernardino County.
J. The Charter School must comply with Education Code Section 51745.6 and California Code of Regulations Section 11704 regarding teacher to ADA limits.
Each enrolled student will be assigned to a credentialed teacher. Student participates with the credentialed teacher and parents in the design of an individualized learning plan that incorporates all aspects of his or her educational program and that serves as the student's learning contract with SMCS.
K. On a regular basis, consistent with the written student agreement, the assigned credentialed teacher and the parent shall evaluate the education program of the student and modify as necessary to maximize student success. The assigned credentialed teacher will have the final authority with regard to the education program of the student, and outcomes with the exception of students who qualify for special education services whose services and outcomes will be determined by an Individual Education plan ("IEP") team pursuant to law. Each student is expected to access and meet the same grade level standards and curriculum that their grade level, general education counterparts are afforded through access to special services, supports, accommodations, and modifications provided to them and outlined on their Individual Education Plan (IEP).
L. Each student who qualifies for special education services under the Individuals with Disabilities Education Improvement Act (“IDEIA”) shall be provided free and appropriate public education services as specified by law following a careful review of their current IEP. Parent will ensure that student attends all legally mandated services as assigned by the school.
As a public school, SMCS does not discriminate against identified special education students, or students guaranteed protections under a 504 Accommodation Plan regardless of their disability. Following enrollment in Sky Mountain Charter School each identified special education student shall attend all scheduled and legally required Special Education services, unless unable to do so due to illness or family emergency, to assist the student in meeting the student’s identified goals and objectives specified in his or her Individual Educational Program (IEP) and to insure that the student’s charter school placement promotes his or her educational benefit. Two unexcused absences or missing more than 50% of a student’s special education services in a month will result in the student being designated truant. Parents/guardians will be invited to an IEP meeting to review their student’s educational progress, and to ensure that this charter school remains the least restrictive environment as required by IDEA in which to promote educational benefit. If the student is twice designated to be truant in the current academic year the school will need to consider whether the parent is blocking access to FAPE by not allowing student to attend services.
M. Acceptance into Sky Mountain Charter School:
A student may be accepted into the charter school upon the following terms and conditions:
The student demonstrates the ability to work within the home based, independent study model.
The student and parent/guardian understand and agree to follow and meet independent study guidelines requirements.
The student and parent/guardian agree to enter into and meet the requirements of a student agreement.
The student demonstrates an age appropriate ability and willingness to work independently under the supervision of adults.
Parents who enroll their children in SMCS shall, through specific enrollment and curriculum contracts, accept responsibility for their children's education. SMCS will support its students and parents both with appropriate educational materials, and with a team of Highly Qualified (as required by the No Child Left Behind Act of 2001 and ESEA) California teacher credentialed Education Specialists, ES Advisors, and school administrators. SMCS Education Specialists and ES Advisors shall advise and assist parents and students in all aspects of student education pursuant to relevant contracts.
Any parent or legally responsible entity may legally designate an alternate party to act in place of the parents. SMCS adult students do not require parental participation in educational or admission contracts, or performance evaluations.
N. Independent Study Roles
The credentialed teacher(s) will:
Ensure that independent study occurs in accordance with state law and charter policy and regulations.
Facilitate the completion of written student agreements.
Supervise and assess approved coursework.
Assign all grades and credits earned and report the information for inclusion in student's permanent record.
Establish, complete, and maintain necessary reports and records, including, but not limited to, learning records and attendance record.
Review Daily Attendance and Engagement Log
Personally judge the time value of student assignments or work products before ADA is earned.
Assess the student's level of education, modifying the curriculum as necessary to meet charter guidelines.
Administer school and state mandated tests as required.
Select and save representative samples of the student's completed and evaluated assignments.
The parents/guardians will:
Understand that attendance at this charter school is entirely voluntary on the part of the students who enroll.
Participate with the credentialed teacher in the development of the student's educational plan.
Keep a Daily Attendance Log provided by the teacher.
Meet with their Education Specialists at least once every 20 school days to review and document attendance and the learning that occurs in that learning period.
Transport their student to each school or state mandated assessment location
Understand that all items supplied and/or obtained through a school purchase are the property of the school. Under the direction of the credentialed teacher, the parent/guardian shall assume responsibility for all items supplied and/or obtained through school including, but not limited to books, materials, supplies, and equipment and will reimburse the school for lost, stolen, or damaged items. The parent/guardian shall return all school provided/owned items to the school upon school request. Parents not returning requested items will be required to pay for those items.
The student will:
Be responsible to fulfilling the written student agreement components.
SMCS Mission Statement
We believe in educating each of our students for the 21st century by providing individualized learning opportunities that incorporate parental participation, choice and involvement in curricula offered in personalized learning environments.
SMCS is not a Federal Title 1 School
SMCS is not a “Title 1 school”, therefore does not have an official federally compliant parent involvement policy. But SMCS believes strongly, emphasized in our mission statement, that parental participation is a key component in our charter school. The following are ways we encourage all of our parents to be involved with us in educating their students.
Parent Participation Opportunities
A. If enrollment at SMCS is chosen for their children, the parents will:
- Understand that attendance at this charter school is entirely voluntary on the part of the students who enroll.
- Participate with the credentialed teacher in the development of the student’s educational plan, initially and on an ongoing basis.
- Supervise the student’s daily work (unless and AESS contract is signed) while following the student’s educational plan as the student is working on assignments.
- Select appropriate curriculum, other educational materials, cp courses and activities in consultation with the Education Specialists.
- Meet face to face with their Education Specialists at least once every 20 school days to review and document attendance and the student learning that occurs during that learning period.
- Transport their student to each school or state mandated assessment location.
- Under the direction of the credentialed teacher, will assume responsibility for supplied school owned books, materials, supplies, and equipment, will return them to the school when work is completed, or the student disenrolls from the school, and will reimburse the school for lost or willfully damaged items.
B. We encourage all parents of enrolled students to apply for open positions on the 19 member SMCS Parent Council. The Role of the Parent Council is to:
- Uphold the mission of school
- Develop/approve short and long term goals
- Monitor school’s performance and review financial reports
- Monitor council’s performance
- Be involved in the WASC accreditation process
- Serve for a one or two year term, as long as their children remain enrolled at SMCS
- Plan to attend all council meetings, in person or by phone conference
- Make suggestions to improve the school
- Establish and/or chair parent sub-committees for a variety of purposes, such as graduation planning, developing a school yearbook, planning group educational activities, grant application, volunteer coordination, etc.
- Be true to school's mission, not a personal agenda
- Be positive!
C. All parents with children enrolled in SMCS have the opportunity to volunteer their time to a Parent Council sub-committee to plan educational school events and activities.
D. From time to time parent training opportunities may be available for SMCS parents.
Students may be suspended or expelled from this charter school for non-compliance with the terms of the parent-student contract, or any material violation of any of the conditions, standards or procedures set forth in the charter school charter, the school handbook, the school’s policies and procedures, or for practices describes in CA Education Code 48900 quoted below. The Special Education Director will be involved in the suspension/expulsion process for all identified pupils with disabilities. Students who fail to demonstrate adequate and appropriate progress toward the student standards, as determined by the professional judgment of the certificated Education Specialist assigned to that student, will be considered truant (as defined by this charter school) and are subject to immediate dismissal from the school.
This charter school will suspend a student from participation in all school events outside of the student’s home if the student is found to have committed any act listed in CA Education Code 48900 that occurs during, or while going to or coming from, a school sponsored class, a school site, an assessment session, or any other school activity. If the student violates their written requirement to be at home during school hours and not at any location where the school is holding educational events, the suspended student is subject to expulsion from the school. The School Director reserves the right to administer alternative discipline action.
CA Education Code 48900
(a) (1) Caused, attempted to cause, or threatened to cause physical injury to another person. (2) Willfully used force or violence upon the person of another, except in self-defense.
(b) Possessed, sold, or otherwise furnished any firearm, knife, explosive, or other dangerous object, unless, in the case of possession of any object of this type, the pupil had obtained written permission to possess the item from a certificated school employee, which is concurred in by the principal or the designee of the principal.
(c) Unlawfully possessed, used, sold, or otherwise furnished, or been under the influence of, any controlled substance listed in Chapter 2 (commencing with Section 11053) of Division 10 of the Health and Safety Code, an alcoholic beverage, or an intoxicant of any kind.
(d) Unlawfully offered, arranged, or negotiated to sell any controlled substance listed in Chapter 2 (commencing with Section 11053) of Division 10 of the Health and Safety Code, an alcoholic beverage, or an intoxicant of any kind, and either sold, delivered, or otherwise furnished to any person another liquid, substance, or material and represented the liquid, substance, or material as a controlled substance, alcoholic beverage, or intoxicant.
(e) Committed or attempted to commit robbery or extortion.
(f) Caused or attempted to cause damage to school property or private property.
(g) Stolen or attempted to steal school property or private property.
(h) Possessed or used tobacco, or any products containing tobacco or nicotine products, including, but not limited to, cigarettes, cigars, miniature cigars, clove cigarettes, smokeless tobacco, snuff, chew packets, and betel. However, this section does not prohibit use or possession by a pupil of his or her own prescription products.
(i) Committed an obscene act or engaged in habitual profanity or vulgarity.
(j) Unlawfully possessed or unlawfully offered, arranged, or negotiated to sell any drug paraphernalia, as defined in Section 11014.5 of the Health and Safety Code.
(k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, administrators, school officials, or other school personnel engaged in the performance of their duties.
(l) Knowingly received stolen school property or private property.
(m) Possessed an imitation firearm. As used in this section, "imitation firearm" means a replica of a firearm that is so substantially similar in physical properties to an existing firearm as to lead a reasonable person to conclude that the replica is a firearm.
(n) Committed or attempted to commit a sexual assault as defined in Section 261, 266c, 286, 288, 288a, or 289 of the Penal Code or committed a sexual battery as defined in Section 243.4 of the Penal Code.
(o) Harassed, threatened, or intimidated a pupil who is a complaining witness or a witness in a school disciplinary proceeding for the purpose of either preventing that pupil from being a witness or retaliating against that pupil for being a witness, or both.
(p) Unlawfully offered, arranged to sell, negotiated to sell, or sold the prescription drug Soma.
(q) Engaged in, or attempted to engage in, hazing as defined in Section 32050.
Expulsions or suspensions will be made by the Charter School Administration based on information provided by the assigned Education Specialist or course instructor according to school policy. The school administration shall notify the student and his/her parents, in writing, of any incident(s) or fact(s) justifying discipline and give the student a reasonable opportunity to cure the violation, unless the school administration determines that the violation constitutes a severe and imminent threat to the health or safety of others in the school. As required by Education Code 48902, a school administrator will notify the appropriate law enforcement authorities of the county or city in which the school is situated, of any acts of the pupil that may violate Section 245 of the Penal Code.
The parents of a student who has received an expulsion notice from the school Administration may request a hearing where the parent/student shall be given an opportunity to participate and present facts relevant to the issues set forth in the expulsion notice. In the event of any such request, the school administration shall appoint a Hearing Committee composed of five (5) members of the School Parent Council which shall conduct an expulsion hearing in a closed session meeting. An expulsion hearing, if requested, shall be conducted in accordance with the due process requirements established in Education Code 48918. After an expulsion hearing, the Hearing Committee shall send its recommendation to the school Administration for a final decision. The school Administration will make all final decisions concerning suspension, expulsion, or reinstatement of suspended or expelled students.
Whenever a pupil is expelled from this charter school, the school shall notify the pupil and the pupil’s parents/guardians in writing of the pupil’s duty to attend the school district in which the residency of either the parent/legal guardian is located.
The charter school will notify the student’s district of residence of the student’s expulsion.
IEM Schools is committed to providing all students with a safe educational environment in which all members of the school community are treated with dignity and respect and are free from harassment, intimidation or bullying. Bullying and harassment of students by students, school employees, volunteers and visitors will not be tolerated at IEM Schools . The school will not tolerate bullying or any behavior that infringes on the safety or well-being of students, staff or any other persons within the school's jurisdiction whether directed at an individual or group. IEM Schools prohibits harassment, bullying, hazing, or any other victimization based on but not limited to any of the following actual or perceived traits or characteristics: age, color, creed, national origin, race, religion, marital status, sex, sexual orientation, gender identity, physical or mental ability or disability, ancestry, political party preference, political belief, socioeconomic status, or familial status.
IEM Schools expects students and/or staff to immediately report incidents of bullying to the Executive Director or designee. A staff member who witnesses such acts will take immediate steps to intervene when safe to do so. Each complaint of bullying or harassment shall be promptly investigated. This policy applies to students at the school office, learning center, testing sites, and during a school-sponsored activity. IEM Schools and its students, parent/guardians and community have an obligation to promote mutual respect and safe, harmonious relations that support dignity and equality. To that end, IEM Schools has in place policies, procedures, and practices that are designed to reduce and eliminate bullying and harassment as well as processes and procedures to address incidents of bullying and harassment when they occur. These policies and procedures must be disseminated annually to staff, students, and parents/guardians.
Parent-teachers should discuss this policy with their students in age-appropriate ways and assure them that they need not endure any form of bullying. Students who bully are in violation of this policy and are subject to disciplinary action up to and including expulsion.
The Student Code of Conduct includes, but is not limited to:
- Any student who engages in bullying may be subject to disciplinary action up to and including expulsion.
- Students are expected to immediately report incidents of bullying to the Executive Director or designee.
- Students can reply on staff to promptly investigate each complaint of bullying in ahorough and confidential manner.
- If the complainant student or the parent of the student feels that appropriate resolution of the investigation or complaint has not been reached, the student or the parent of the student should contact the Executive Director. The school system prohibits retaliatory behavior against any complainant or any participate in the complaint process.
The procedures for intervening in bullying behavior include, but are not limited, to the following:
- All staff, students, and their parents will receive a summary of this policy prohibiting intimidation and bullying: at the beginning of the school year, as part of the Parent/Student Handbook and/or information packet, as part of new school orientation, and as part of the school system's notification to parents.
- IEM Schools will make reasonable efforts to keep a report of bullying and the results of investigation confidential.
- Staff who witness acts of bullying shall take immediate steps to intervene when safe to do so. People witnessing or experiencing bullying are strongly encouraged to report the incident; such reporting will not reflect on the target or witnesses in any way.
In addition to the grounds specified in Education Code sections 48900, sections 48900.2, 48900.3, and 48900.4 provide additional authority to discipline a student in any of grades 4 to 12, inclusive for conduct that amounts to bullying. (Education Code 48900, 48900.2, 48900.3 and 48900.4)
Reporting Violations of this Policy The Executive Director or her designee at IEM Schools shall be responsible for receiving complaints alleging violations of this policy. All staff are expected to provide appropriate supervision to enforce standards of conduct and, if they observe or become aware of bullying or harassing behavior, to immediately intervene, call for assistance, and report such incidents. The Parent Council requires that staff follow school procedures for reporting alleged acts of bullying and take all necessary action to protect the victim of bullying.
All other members of the school community, including students, parents/guardians, volunteers, and visitors, are encouraged to report any act that may be a violation of this policy. While submission of the report form is not required, the reporting party is encouraged to use the report form available from the Executive Director of Student Services. Oral reports shall also be considered official reports. Reports may be made anonymously, but formal disciplinary action may not be based solely on an anonymous report. Prompt and reasonable investigation of alleged acts of bullying is expected. Students are expected to report all incidents of bullying, teasing, or other verbal or physical abuse. Any students' who feel she/he is a victim of such behavior should immediately contact a teacher, counselor, administrator, or staff person. If the student who was bullied believes the situation has not been remedied, he/she may file a complaint in accordance with IEM Schools procedures. Students are to be informed annually of the process by which they may make a report of bullying or harassment.
Retaliation is Prohibited Retaliation against a student because the student has filed a bullying complaint or assisted or participated in a bullying or harassment investigation or proceeding is also prohibited. Students who knowingly file false bullying or harassment complaints or give false statements in an investigation shall be subject to discipline by measures up to and including suspension and expulsion, as shall any student who is found to have retaliated against another in violation of this policy.
Confidentiality An allegation of bullying that involves sexual harassment, and the results of an investigation, shall be kept confidential to the extent reasonably possible.
Explanation of Terms Bullying is defined as any severe or pervasive physical or verbal act or conduct, including communications made in writing or by means of an electronic act, as defined, including but not limited to sexual harassment, hate violence or harassment, threats or intimidation, that has the effect or can reasonably be predicted to have the effect of placing a reasonable pupil, as defined, in fear of harm to that pupil's or those pupil's person or property, causing a reasonable pupil to experience a substantially detrimental effect on his or her physical or mental health, causing a reasonable pupil to experience substantial interference with his or her academic performance, or causing a reasonable pupil to experience substantial interference with his or her ability to participate in or benefit from the services, activities or privileges provided by a school.
Reasonable student means a pupil including, but not limited to, an exceptional needs student, who exercises average care, skill and judgment in conduct for a person of his or her age, or for a person of his or her age with his or her exceptional needs. Examples of bullying may include but are not necessarily limited to the following:
Verbal: Hurtful name-calling, teasing, gossiping, making threats, making slurs or epithets, making rude noises, or spreading hurtful rumors.
Nonverbal: Posturing, making gang signs, leering, staring, stalking, destroying property, insulting or threatening notes, using graffiti or graphic images, or exhibiting inappropriate and/or threatening gestures or actions.
Physical: Hitting, punching, pushing, shoving, poking, kicking, tripping, strangling, hair pulling, fighting, beating, "pantsing", pinching, slapping, biting, spitting, or destroying property.
Emotional (Psychological): Rejecting, terrorizing, extorting, defaming, intimidating, humiliating, blackmailing, manipulating friendships, isolating, shunning, ostracizing, using peer pressure, or rating or ranking personal characteristics.
Cyber Bullying is defined as: Electronic act means the transmission of a communication, including, but not limited to, a message, text, sound, or image, or a post on a social network Internet Website, by means of an electronic device, including, but not limited to, a telephone, wireless telephone or other wireless communication device, computer or pager.
The following is intended to provide guidance to assist staff and students in identifying bias-based behavior:
1. Citizenship/Immigration Status: actual or perceived immigration status or status as a citizen of a country other than the United States of America.
2. Disability: actual or perceived disability, or history of disability. The term "disability" applies to a person who (1) has a physical, emotional or mental impairment that substantially limits one or more major life activities, (2) has a record of such impairment, (3) is regarded as having such impairment. Major life activities include caring for one's self, walking, seeing, hearing, speaking, breathing, working, performing manual tasks, and learning. Some examples of impairments which may substantially limit major life activities, even with the help of medication or aids/devices, are: AIDS, alcoholism, blindness or visual impairment, cancer, deafness or hearing impairment, diabetes, drug addiction, heart disease, and mental illness.
3. Ethnicity/National Origin: actual or perceived national origin or ethnic identity. National origin is distinct from race/color or religion/creed because people of several races and religions or their forbears may come from one nation. The term "national origin" includes members of all national groups and groups of persons of common ancestry, heritage or background; it also includes individuals who are married to or associated with a person or persons of a particular national origin.
4. Gender: actual or perceived gender, pregnancy, or conditions related to pregnancy or childbirth. The prohibition against gender discrimination includes sexual harassment.. Race/Color: actual or perceived race or color.
6. Religion/Creed: actual or perceived religion or creed (set of fundamental beliefs, whether or not they constitute a religion)
7. Sexual Orientation: actual or perceived sexual orientation. The term sexual orientation means heterosexuality, homosexuality, bisexuality or transgender identity.

All Innovative Education Management (IEM) schools will follow regulations regarding enrollment and education of homeless children. IEM will have a Homeless Liaison to set policy and procedure for all schools. Each school will have a homeless liaison prepared to assist student as described in Administrative Directive AR 6173 enrolled in specific school.
AR 6173 Administrative Direction
Definitions Homeless means students who lack a fixed, regular, and adequate nighttime residence and includes: (42 USC 11434a)
1. Children and youths who are sharing the housing of other persons due to loss of housing, economic hardship, or a similar
reason; are living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations; are living in emergency or transitional shelters; are abandoned in hospitals; or are awaiting foster care placement (cf. 6173.1 - Education for Foster Youth)
2. Children and youths who have a primary nighttime residence that is a public or private place not designed for or ordinarily
used as regular sleeping accommodations for human beings
3. Children and youths who are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train
stations, or similar settings
4. Migratory children who qualify as homeless because the children are living in conditions described in (1)-(3) above
School of origin means the school that the student attended when permanently housed or the school in which the student
was last enrolled. (42 USC 11432)
Best interest means, to the extent feasible, continuing a student's enrollment in the school of origin for the duration of his/her homelessness, except when doing so is contrary to the wishes of his/her parent/guardian. (42 USC 11432)
Unaccompanied youth means a youth not in the physical custody of a parent or guardian. (42 USC 11434(a))

The School's liaison for homeless students shall ensure that: (42 USC 11432)
1. Homeless students are identified by school personnel and through coordinated activities with other entities and
agencies (cf. 1400 - Relations between Other Governmental Agencies and the Schools) (cf. 5141.6 - Student Health and Social Services)
2. Homeless students enroll in, and have a full and equal opportunity to succeed in, district schools
3. Homeless families and students receive educational services for which they are eligible
4. Parents/guardians are informed of the educational and related opportunities available to their children and are provided with meaningful opportunities to participate in the education of their children
5. Notice of the educational rights of homeless children is disseminated at places where children receive services, such as schools, shelters, and soup kitchens
6. Enrollment disputes are mediated in accordance with law, Board policy, and administrative regulation
7. Parents/guardians are fully informed of all transportation services (cf. 3250 - Transportation Fees) (cf. 3541 - Transportation Routes and Services)
8. Communicate with IEM Homeless Liaison, Director of Teacher Support, enrollment staff, student assignment staff. When
student is assigned the School Homeless Liaison will contact the Education Specialist offering homeless resource information.
Placement decisions for homeless students shall be based on the student's best interest. In determining a student's best interest, a homeless student shall, to the extent feasible, be placed in his/her school of origin, unless his/her parent/guardian requests otherwise. (42 USC 11432)
When making a placement decision, the IEM Director of Teacher Support may consider the age of the student, the distance of the commute and the impact it may have on the student's education, personal safety issues, the student's need for special instruction, the length of anticipated stay in the temporary shelter or other temporary location, likely area of future housing, school placement of siblings, and the time remaining in the school year.
The student may continue attending his/her school of origin for the duration of the homelessness and until the end of any
academic year in which he/she moves into permanent housing. (42 USC 11432)
In the case of an unaccompanied youth, homeless liaison shall assist in placement or enrollment decisions, consider the views
of the student, and provide notice to the student of his/her appeal rights. (42 USC 11432)
If the student is placed at a school other than his/her school of origin or the school requested by his/her parent/guardian, the IEM Homeless Liaison or designee shall provide the parent/guardian with a written explanation of the decision along with a statement regarding the parent/guardian's right to appeal the placement decision. (42 USC 11432)
Once a placement decision has been made, the IEM Homeless Liaison or designee shall work with student assignment staff to enroll the student in the school of choice, even if the parent/guardian is unable to provide the school with the records normally required for enrollment. The School Homeless Liaison will work with appropriate staff to ensure immediate contact to the school last attended by the
student to obtain the relevant records. If the student needs to obtain immunizations or does not possess immunization or other medical records, the School's Liaison for homeless students shall assist the parent/guardian in obtaining the necessary immunizations or records for the student. Enrollment Dispute Resolution Process
If a dispute arises over school selection or enrollment in a particular school, the student shall be immediately admitted to
the school in which enrollment is sought pending resolution of the dispute. (42 USC 11432) Disputes will be sent to IEM and
School Homeless Liaison.
The parent/guardian shall be provided with a written explanation of the placement decision,including an explanation of the parent/guardian's right to appeal the decision. He/she shall also be referred to the school liaison. (42 USC 11432)
The written explanation shall be complete, as brief as possible, simply stated and provided in language that the parent/guardian or student can understand. The explanation may include contact information for the School liaison, a description of the School's decision, notice of the right to enroll in the school of choice pending resolution of the dispute, notice that enrollment includes full participation in all school activities, and notice of the right to appeal the decision to the county office of education and, if the dispute remains unresolved, to the California Department of Education.
The IEM and School Liaison shall carry out the dispute resolution process as expeditiously as possible after receiving notice of the dispute. (42 USC 11432)
If a parent/guardian disagrees with the liaison's enrollment decision, he/she may appeal the decision to the Executive Director. The Executive Director shall make a determination within five school days.
If the parent/guardian wishes to appeal the School's placement decision, the School's liaison shall forward all written documentation and related paperwork to the homeless liaison at the county office of education.

It is the policy of IEM Schools that all school personnel, staff, students, and students' parents are required to be civil in all of their interpersonal school-related interactions. Civility does not require unqualified agreement or conformity of opinion. Under no circumstances will uncivil conduct at any school-related activity be tolerated.
For purposes of this policy, to be civil means to act with self discipline in a courteous, respectful and orderly way in every interpersonal communication and behavior. It also means that a person will treat other persons as he or she would like to be treated.
Uncivil conduct includes, but is not limited to: using an inappropriately loud voice; using profane, vulgar, or obscene words or gestures; belittling, jeering, or taunting; using personal epithets; using violent or aggressive gestures or body-language; repeatedly and inappropriately interrupting another speaker; repeatedly demanding personal attention at inappropriate times; purposefully and inappropriately invading personal space; purposefully ignoring appropriate communications; wrongfully interfering with another person's freedom of movement; wrongfully invading another person's private possessions; or, any other behavior that inappropriately disrupts school-related activities.
An expression of disagreement or a discussion of a controversial viewpoint is not uncivil if such expression or discussion is appropriately presented and does not disrupt a school-related activity.
Any school personnel who are uncivil shall be subject to disciplinary action.
Any student that is uncivil shall be subject to an administrative hearing and review for expulsion or dismissal.
In the event that any student's parent is uncivil during a school-related activity, school personnel to whom the uncivility is directed shall immediately warn the parent tocommunicate or act civilly. If the parent fails to correct the uncivil behavior as directed, the affected school personnel shall notify the parent that the school activity is terminated, and the affected school personnel shall refer the matter to school administrative personnel for further administrative or legal action, which may include, but may not be limited to, a prohibition from any further participation in schoolrelated activities.

We understand that social media can be a fun and rewarding way to share your life and opinions with family, friends and coworkers around the world. However, use of social media also presents certain risks and carries with it certain responsibilities. To assist you in making responsible decisions about your use of social media, we have established these guidelines for appropriate use of social media.
In the rapidly expanding world of electronic communication, social media can mean many things. Social media includes all means of communicating or posting information or content of any sort on the Internet, including to your own or someone else's web log or blog, journal or diary, personal website, social networking or affinity web site, web bulletin board or a chat room, whether or not associated or affiliated with the Company as well as any other form of electronic communication. The same principles and guidelines found in Company policies and three basic beliefs apply to your activities online. Ultimately, you are solely responsible for what you post online. Before creating online content, consider some of the risks and rewards that are involved. Keep in mind that any of your conduct that adversely affects your job performance, the performance of fellow associates or otherwise adversely affects members, customers, suppliers, people who work on behalf of the Company or the Company's legitimate business interests may result in disciplinary action up to and including termination.
You are responsible for what you post on your own site and on the sites of others. Individual bloggers have been held liable for commentary deemed to be copyright infringement, defamatory, proprietary, libelous, or obscene (as defined by the courts). You are also responsible for complying with the existing rules of social media web sites. Increasingly, employers are conducting Web searches on job candidates before extending offers. Be sure that what you post today will not come back to haunt you.
Carefully read these guidelines along with the Company Standards of Conduct and AntiHarassment policies in this Employee Handbook, and ensure your postings are consistent with these policies. Inappropriate postings that may include discriminatory remarks, harassment,
and threats of violence or similar inappropriate or unlawful conduct will not be tolerated and may subject you to disciplinary action up to and including termination.
Always be fair and courteous to fellow associates, customers, members, suppliers or people who work on behalf of the Company. Also, keep in mind that you are more likely to resolve workrelated complaints by speaking directly with your coworkers other than by posting
complaints to a social media outlet. Nevertheless, avoid using statements, photographs, video or audio that reasonably could be viewed as malicious, obscene, threatening or intimidating, that disparage students or their families, associates or suppliers, or that might constitute harassment or bullying. Examples of such conduct might include offensive posts meant to intentionally harm someone's reputation or posts that could contribute to a hostile work environment on the basis of race, sex, disability, religion or any other status protected by law or company policy.
Make sure you are always honest and accurate when posting information or news, and if you make a mistake, correct it quickly. Be open about any previous posts you have altered. Remember that the Internet archives almost everything; therefore, even deleted postings can be searched. Never post any information or rumors that you know to be false about the Company, fellow associates, students or their families, suppliers, people working on behalf of the Company or competitors.
Maintain the confidentiality of Company trade secrets and private or confidential information. Trades secrets may include information regarding the development of systems, processes, products, know how and technology. Do not post internal reports, policies, procedures or other internal businessrelated confidential communications.
Do not create a link from your blog, website or other social networking site to a Company website without identifying yourself as a Company associate.
Express only your personal opinions. Never represent yourself as a spokesperson for the Company. If the Company is a subject of the content you are creating, be clear and open about the fact that you are an associate and make it clear that your views do not represent those of the Company, fellow associates, members, customers, suppliers or people working on behalf of the Company. If you do publish a blog or post online related to the work you do or subjects associated with the Company, make it clear that you are not speaking on behalf of the Company. It is best to include a disclaimer such as "The postings on this site are my own and do not necessarily reflect the views of the Company."
Refrain from using social media while on work time or on equipment we provide, unless it is workrelated as authorized by your manager or consistent with the Company Equipment Policy. Do not use Company email addresses to register on social networks, blogs or other online tools utilized for personal use.
Associates should not speak to the media on the Company's behalf without contacting the Director of Human Resources. All media inquiries should be directed to the (School Director / Director of Human Resources).
